TERMS OF SERVICE.

Effective date: April 30, 2026

These Terms of Service ("Terms") govern your access to and use of the Pick1 mobile application and related services (the "Service") provided by Pick1 ("we", "us", "our").

By creating a Pick1 account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What Pick1 is

Pick1 is an entertainment and informational service that uses artificial intelligence to generate sports predictions for major leagues including NBA, NFL, NHL, MLB, EPL, UFC, F1, and IPL Cricket.

Pick1 is a sports content and analysis service, comparable to ESPN, The Athletic, or FiveThirtyEight. The "save pick" and similar in-app actions add a recommendation to your tracked-picks list inside Pick1 only — they do not interact with any third-party platform. Pick1 does not facilitate, accept, or process wagers of any kind, and we do not integrate with any sportsbook, betting service, or financial-transaction platform beyond the Pick1 Pro subscription, which Apple processes directly through StoreKit.

Pick1 is not financial or investment advice. AI predictions are statistical estimates with documented uncertainty. Past performance does not predict future results. Use Pick1 picks for entertainment and as one of many inputs to your own decision-making — never as a guaranteed outcome.

2. Eligibility

You must be at least 13 years old (or the minimum age required by your jurisdiction's data-protection law — for example, 16 under GDPR for users in some EU member states) to use Pick1. By using the Service you represent and warrant that:

• You meet the minimum age requirement above
• You have full legal capacity (or your parent/legal guardian has provided consent on your behalf) to enter into these Terms
• You will use Pick1 in compliance with all applicable laws in your jurisdiction

3. Account creation and security

To use most features of Pick1 you create an account. You agree:

• To provide accurate, current information (currently just an email)
• To keep your account credentials confidential
• To notify us immediately at support@pick6.app if you suspect unauthorized access
• That you are responsible for all activity that occurs under your account

We may suspend or terminate accounts that violate these Terms (see Section 11).

4. Subscriptions

4.1 Free vs Pro

Pick1 offers two tiers:

4.2 Free trial

The 7-day free trial applies to new subscribers of the Weekly product only. The trial begins when you tap "Start 7-Day Free Trial". At the end of the 7th day, your subscription auto-renews at $14.99/week unless you cancel at least 24 hours before the trial ends.

If you have previously subscribed to or trialed any Pick1 Pro product, you are not eligible for another free trial.

4.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel:

• Weekly: renews every 7 days at $14.99
• Monthly: renews every 30 days at $39.99

Your iTunes account is charged within 24 hours of the end of the current period.

4.4 How to cancel

Manage and cancel subscriptions in iOS Settings → [your Apple ID] → Subscriptions → Pick1 Pro. Cancellation takes effect at the end of the current billing period — you keep Pro access until then.

We do not process cancellations directly. Apple handles all subscription management.

4.5 Refunds

Refunds are issued by Apple, not Pick1. Request a refund at https://reportaproblem.apple.com or via iOS Settings → [your Apple ID] → Subscriptions → Pick1 Pro → Report a Problem.

4.6 Price changes

We may change subscription prices for new subscribers at any time. Existing subscribers will be notified at least 30 days before any price increase takes effect on their plan. Continuing the subscription after the change date constitutes acceptance of the new price.

5. Acceptable use

You agree NOT to:

• Use Pick1 for any illegal purpose, including in jurisdictions where AI sports predictions are prohibited
• Reverse-engineer, decompile, or attempt to extract Pick1's source code
• Scrape, bulk-download, or systematically harvest predictions from Pick1 (the predictions are our intellectual property — see Section 7)
• Resell, redistribute, or republish Pick1 predictions to third parties
• Impersonate another person or create accounts under false pretenses
• Use Pick1 to harass, threaten, or harm other users
• Interfere with the Service's normal operation (e.g. denial of service, exploiting bugs, automated scripts)
• Provide false information during account creation

We reserve the right to investigate and take legal action against anyone who, in our sole discretion, violates these provisions.

6. AI predictions disclaimer

Pick1 predictions are AI-generated estimates, not guarantees. Specifically:

• Predictions are generated by Anthropic Claude Opus 4.7, an AI model with documented uncertainty
• The model's stated probability (e.g. "76%") is a best estimate of the matchup's outcome based on available information at the time of generation
• Real-world outcomes are influenced by factors the AI cannot perfectly observe (last-minute injuries, lineup changes, weather, ref decisions, etc.)
• Long-run accuracy may vary from the AI's stated probabilities, particularly during model updates or unusual seasons

By using Pick1 you acknowledge that:

• You are not relying on Pick1 recommendations as the sole basis for any sports-related decision
• Pick1 is not liable for losses arising from decisions you make based on AI predictions

7. Intellectual property

7.1 Our content

Pick1, the Pick1 logo, the AI predictions generated by the Service, and all other content, design elements, and software comprising the Service are owned by Pick1 and protected by U.S. and international copyright, trademark, and other intellectual property laws.

7.2 Your license

We grant you a limited, non-exclusive, non-transferable, revocable license to use Pick1 for personal, non-commercial use, subject to these Terms.

This license does not include the right to:

• Copy or modify the app
• Use the predictions for commercial resale
• Make the app available to others (e.g. via Family Sharing — Pick1 disables this in Section 4.2 of SUBSCRIPTION_METADATA.md)
• Create derivative works

7.3 Feedback

If you send us feedback, suggestions, or ideas about Pick1, we may use them without compensation, attribution, or any obligation to you.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure
• AI predictions will be accurate, complete, or up-to-date in all instances
• Subscription billing will always succeed (it depends on Apple's systems)
• The Service will be available in your jurisdiction

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PICK6, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING (WITHOUT LIMITATION) LOST PROFITS, LOST REVENUE, OR DATA LOSS ARISING FROM:

• Your use of or inability to use the Service
• Any AI prediction's accuracy or your reliance on it
• Decisions you make based on Pick1 content
• Unauthorized access to your account
• Any third-party content or services accessed through Pick1

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF:

(A) THE AMOUNT YOU PAID PICK6 IN THE 12 MONTHS BEFORE THE CLAIM, OR
(B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of consequential damages, so some of the above may not apply to you.

11. Termination

You may terminate your account at any time by tapping Profile → Settings → Delete Account in the app, or by emailing support@pick6.app. Your account will be deleted within 30 days of the request.

We may suspend or terminate your access if we determine, in our sole discretion, that:

• You have violated these Terms
• Continued service would expose us to legal risk
• We are required to do so by law

Upon termination, your license to use the Service ends immediately. Sections that by their nature should survive termination (e.g. Sections 9, 10, 12) will survive.

12. Governing law and disputes

12.1 Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles.

12.2 Informal resolution

Before filing a claim, you agree to try to resolve the dispute informally by emailing support@pick6.app. We'll acknowledge within 5 business days and respond substantively within 30 days.

12.3 Arbitration

If informal resolution fails, all disputes will be resolved through binding arbitration administered by JAMS in Delaware, USA, on an individual basis. You waive your right to participate in a class action or class arbitration.

This arbitration provision does not apply to:

• Small claims court matters
• Claims for injunctive relief regarding intellectual property infringement

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app banner at least 30 days before they take effect. Continued use of Pick1 after the effective date of revised Terms constitutes acceptance.
